Unlimited Service may not be available in some areas. A network charge of $4.95 per month applies on all accounts; and may be waived from time to time for new and/or existing clients as a promotional tool.
Offer excludes Mexico, Alaska, and Hawaii.
General Terms And Conditions ("Agreement")
Simple Long Distance
In this Agreement: "You" and "Your" includes an applicant, customer, individual, corporation or other type of legal entity which has subscribed for services.
Use Of Services
You may use the services subscribe for provided that You do so in compliance with this Agreement. You acknowledge that You are allowed to subscribe for the services and agree that You will not resell or transfer the services to any other person for any purpose or make any charge for the use of the service. The services is provided to You as a residential user, for Your usual personal, residential, non-professional and non-business use only, and may not be used in any other way. Simple Long Distance reserves the right to, without notice; suspend, terminate or modify the service if Simple Long Distance determines in its sole discretion, that Your service is being misused, including, and without limitation, use for commercial or non-residential purposes and usage exceeding conventional residential use.
Responsibility For Charges
You are responsible for all charges for services that You are subscribed to regardless of who used the services, including network fees, system access fee(s), long distance fees not covered by the monthly rate plan, monthly service charges, and any other charges incurred during use of Your services. Ancillary services, including but not limited to, service modifications and changes, TTY, directory assistance, etc. will result in additional monthly charges from Simple Long Distance. Simple Long Distance does not supply collect call service. If You accept collect calls they will continue to be billed as part of your regular home phone service, through your current telephone provider. Simple Long Distances Service(s) are not intended for use calling to/from Chat and/or Party lines. Calls to Chat/Party lines will be billed separately at varying rates depending on they type and length of the call. Some such calls may also be billed on your local phone bill rather than your Simple Long Distance invoice.
Local Services
Transfer of Long Distance Telephone service. You agree that in the event that Your local line services are terminated, You are solely responsible for contacting an alternate service provider; and for contacting Simple Long Distance to restore long distance service once Your local line service is connected again. You acknowledge that you need to notify Simple Long Distance if at anytime You transfer Your local line provider, change Your local phone number, or change Your physical address; such changes will cause interruption in services and notification may reduce the length of interruption.
YOU AGREE TO IMMEDIATELY ADVISE SIMPLE LONG DISTANCE IF:You intend on changing the address from which You use Your service. If You fail to do so, You will be held responsible for all charges made using Your services, even if the charges were not made or approved by You.
Transfer To Simple Long Distance
Simple Long Distance will not be responsible for any termination charges imposed by any other provider as a result of You transferring. Be aware that You are still responsible; through your current provider, for all long distance calls made on Your line until Simple Long Distance is able to activate the service. (up to 6 business days). Simple Long Distance will attempt to contact you via phone/email to notify You that the service is active. In the event Simple Long Distance fails to reach You; Your service will still begin its billing cycle. It is Your responsibility to confirm connection date.
Changes Or Termination
Simple Long Distance may at any time and without notice, change, or terminate any rates, plans or plan features, in whole or in part, including increasing rates. In the event of any such change, You will be responsible for paying all charges incurred for use of the services, including charges resulting from the change or modification.
Payments And Billing
Monthly charges will begin on date of activation or delivery of services even if You have not used Your service(s). Fixed charges per service are payable monthly when billed.
SIMPLE LONG DISTANCE subscribers will be billed each month according to the terms of their Plan. Applicable Usage Rates, Monthly Plan Fees and Network Access Fees will be charged.
For subscribers enrolled under a Plan that is subject to a Monthly Plan Fee or a Network Access Fee, these charges will commence on the date of activation with Simple Long Distance. Pro-rated charges will be applied on the first statement, calculated only beginning from this activation date.
Charges will be automatically billed monthly via your personal chequing account or authorized credit card.
You authorize SIMPLE LONG DISTANCE to charge your credit card/chequing account.
You will promptly notify SIMPLE LONG DISTANCE of any changes to your credit card account, billing address or any other information that may prevent payment collection.
You are responsible for payment to Simple Long Distance of charges for all service(s) furnished to You. Payment is due Twenty-One (21) days after the date of the billing invoice. You will be charged interest on outstanding past due amounts at the monthly compounded rate of 2% or such other rate as Simple Long Distance may set from time to time. In addition, an Administrative Surcharge will apply to payments; including cheques, credit card and pre-authorized debit payments, which are returned for any reason. eg. as Not Sufficient Funds ("NSF"). In exceptional circumstances, for example, where You present an abnormal risk of loss to Simple Long Distance, prior to the normal billing date Simple Long Distance may require payment from You on a temporary basis for the charges that have accrued. In such cases, the charges will be considered past due three (3) days after they are incurred or three (3) days after Simple Long Distance demands payment, whichever occurs later. Simple Long Distance sells service in Thirty (30) day blocks. The service is non-refundable and is only pro-rated during transition periods, or as approved by Simple Long Distance. If the services are suspended mid-month for non-payment, You are responsible for the full monthly fee. You must bring invoice inquires or disputes to Simple Long Distance’s attention within Sixty (60) days of the date of the invoice, or You will be deemed to have accepted the invoice.
